Court is expensive and time-consuming. Before legal action, you should usually try to resolve things through alternative methods:

Negotiation

Sometimes directly speaking with the other party to agree a solution can resolve the dispute efficiently.

Mediation

Bringing in a neutral third party to facilitate a settlement between the disputing parties.

Arbitration

If the contract contains an arbitration clause, or if both parties agree. More formal, but often faster than court.

Adjudication / Expert Determination

Especially in technical or construction-related disputes. An expert determines certain technical points, or an adjudicator makes a binding decision.

Remedies for Breach of Contract

If one party breaches the contract, the non-breaching party may have several options

FAQs (Frequently Asked Questions)

How long do I have to bring a contract claim?

There are limitation periods under the Limitation Act 1980: typically 6 years from the breach for simple contracts, but sometimes shorter or longer depending on type and whether dealing with a deed.

Can I ask for specific performance instead of just asking for damages?

Sometimes yes—if the subject matter is unique, or damages are not sufficient. But the court has discretion, and specific performance is not always available.

What happens if the other party tries to avoid their obligations by claiming an event made performance impossible?

They might try to rely on frustration or force majeure. Whether that works depends on the contract wording, whether the event was truly unforeseen, and whether performance is now impossible or fundamentally different.

Do I always have to go to court?

No, courts encourage early resolution, and litigation is often the last resort after negotiation, mediation, or arbitration.

We resolve disagreements between individuals or businesses over written or verbal agreements, including missed payments, work not completed, or unfair contract terms.
